Terms of service
Terms governing the use and sale of the ImmoGrade service. Please read these terms carefully before using the platform.

1. Purpose
These Terms of Service (the "Terms") govern access to and use of the ImmoGrade service (the "Service"), operated by [TO BE COMPLETED — company name], a [TO BE COMPLETED — legal form] with share capital of [TO BE COMPLETED], registered with the [TO BE COMPLETED — RCS] trade register under company number [TO BE COMPLETED], with its registered office at [TO BE COMPLETED — full address] ("ImmoGrade", "we", "us").
By creating an account or using the Service, you acknowledge that you have read, understood and accepted these Terms in full and without reservation.
2. Definitions
- Service: the ImmoGrade platform and all its features, accessible via the website.
- User: any natural person of legal age acting on their own behalf or on behalf of a legal entity.
- Account: secure personal area providing access to the Service.
- Report: PDF document generated by the Service displaying an air quality and pollen score for a given address.
- Credit: consumption unit allowing the generation of one Report.
- Subscription: paid plan granting a monthly Credit allowance.
3. Acceptance of terms
Use of the Service is subject to prior acceptance of these Terms. If you do not accept these Terms, you must not use the Service. ImmoGrade reserves the right to update the Terms at any time; the version in force is the one published on the website at the time of use.
4. Description of the service
ImmoGrade is an online service intended for real estate professionals. Based on a postal address, it generates a Report summarizing air quality and pollen exposure at that location. The Service includes:
- generation of branded PDF Reports;
- sharing Reports via a public URL;
- management of a monthly Credit allowance based on the chosen plan;
- advanced professional features (agency branding, team management, batch generation, etc.).
Important notice. Reports are provided for informational and indicative purposes only. They do not constitute a regulatory diagnostic or medical recommendation and shall not replace any official health or environmental assessment.
5. User account
Access to paid features requires the creation of an Account. The User undertakes to provide accurate, complete and up-to-date information and to keep it as such. The User is solely responsible for the confidentiality of their credentials and for any activity carried out from their Account. Any suspected fraudulent use must be reported to ImmoGrade without delay.
6. Credits, subscriptions and billing
The Service operates on a Credit system tied to a monthly or annual Subscription. Each Report generation consumes one Credit. New Users receive a free allowance of Credits upon signup. Beyond that, the User may subscribe to a paid Subscription.
- Billing cycle: monthly or annual, automatically charged at each renewal via Stripe.
- Renewal: automatic, unless the User cancels before the end of the current period.
- Credit reset: unused Credits do not roll over to the next cycle.
- Payment methods: credit/debit card via Stripe; ImmoGrade never directly stores card data.
- VAT: all prices are displayed excl. VAT. French VAT applies in accordance with applicable regulations.
7. Right of withdrawal and refunds
The Service constitutes digital content supplied on an intangible medium whose execution begins immediately upon subscription with the User's express consent. Pursuant to article L.221-28 of the French Consumer Code, the User expressly waives their fourteen (14) day right of withdrawal upon first use of the Service.
Used Credits are non-refundable. Cancellation of a Subscription takes effect at the end of the current billing period, with no proration.
8. Conditions of use
The User undertakes to use the Service lawfully and as intended. The User shall not:
- use the Service for unlawful or fraudulent purposes;
- attempt to gain unauthorized access to ImmoGrade systems or third-party data;
- scrape or extract content from the Service en masse;
- resell Reports as a stand-alone product;
- share credentials with unauthorized third parties;
- interfere with the integrity or availability of the Service.
9. Third-party data and report limitations
Reports rely on public data made available by third-party providers, in particular Google Air Quality API and Google Pollen API. These data are supplied "as-is" by these providers and may contain inaccuracies, gaps or update delays.
ImmoGrade does not warrant the accuracy, completeness or timeliness of the data displayed in Reports. No medical, health or regulatory decision shall be made solely based on a Report.
10. Intellectual property
All elements making up the Service (software, scoring methodology, design, trademarks, logos, text, database) are the exclusive property of ImmoGrade or its licensors. Any unauthorized reproduction, representation or use is prohibited.
The User retains ownership of any content uploaded (logo, agency mentions). The User grants ImmoGrade a non-exclusive license to use such content as strictly necessary for operating the Service.
11. Service availability
ImmoGrade endeavors to ensure the Service is available 24/7 but cannot guarantee continuous availability. The Service may be temporarily suspended for maintenance or in the event of force majeure.
12. Limitation of liability
To the extent permitted by applicable law, ImmoGrade's liability is limited to direct, foreseeable and proven damages suffered by the User. ImmoGrade shall not be liable for indirect damages including loss of business opportunity, loss of data, reputational harm or loss of chance.
In any event, ImmoGrade's total liability under these Terms is capped at the amounts actually paid by the User during the twelve (12) months preceding the triggering event.
13. Suspension and termination
The User may cancel their Subscription and delete their Account at any time from their personal area. ImmoGrade may suspend or terminate access to the Service in case of serious breach of these Terms, including fraudulent use or non-payment.
14. Changes to terms
ImmoGrade reserves the right to amend these Terms at any time. Material changes will be notified to the User by email and/or via the Service before they take effect. Continued use after a change constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their formation, interpretation or performance shall be submitted to the competent courts of the jurisdiction in which ImmoGrade's registered office is located, subject to mandatory consumer protection rules.
In case of conflict between the French and English versions of these Terms, the French version shall prevail.
